Attorney David A. Wijewickrama has more than 20 years of experience providing legal guidance to individuals, businesses and law enforcement throughout western North Carolina. He is certified to practice in Cherokee Tribal Court, Federal Court and all State courts. He has a long history of providing legal guidance to law enforcement officers, county governments and assisting agencies in all aspects of Law Enforcement office management, Officer Involved Shootings and other legal matters unique to law enforcement agencies. He currently represents three county sheriff’s offices and several private businesses. His current focus is on complex civil litigation, class actions and civil rights issues.

David earned his B.S. from the University of South Carolina in computer information systems, where he attended under a United States Navy scholarship. He graduated Washburn University School of Law in 2000, where he earned his J.D. He also served as a U.S. Naval Officer in the Pacific Fleet. David served on an amphibious carrier and at a 3 star command staff as a supply corp officer. He is active in the legal community of western North Carolina on the state and federal level and has represented law enforcement officers, clients and businesses in a variety of matters. David has received training as a hostage negotiator, Internal Affairs, Public Records and Public Information, evidence locker management, gun rights, and responding to critical incidents.

His recent cases include defending the Sheriff of Ashe County in a removal petition with companion felony charges. All charges were dismissed, the Sheriff was reinstated and his attorney’s fees paid.He also co-counseled in defending deputies in an Officer Involved Shooting (OIS) in Federal Court where his team earned a favorable defense verdict from the jury. In addition to representing departments, David has also represented the Fraternal Order of Police (FOP) and their members for close to 20 years in responding to lawful shootings that ended in the Officers being cleared of any wrongdoing or criminal charges.

Before starting his own practice, David was a Sept. 11th tort litigator and a member of the Buncombe County District Attorney’s Office.

David was raised in Haywood County, North Carolina. He is a former Eagle Scout and takes great pride in being able to serve his neighbors in their time of need. He has one brother who is a NC District Court Judge and another who is a ENT surgeon in Boston, MA. He loves spending time with his nieces and nephews.  When he is not practicing law, you can find him fly fishing, spending time with family and training his dog.
